1. Acceptance of Terms
By downloading, installing, accessing, or using any mobile application (each an "App" and collectively the "Apps") developed, published, or distributed by Top Developer LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, access, or use the Apps.
These Terms constitute a legally binding agreement between you and Company. They apply to all users of the Apps, including visitors, registered users, and purchasers of in-app content or subscriptions.
Apple Inc. ("Apple") is not a party to these Terms (except to the extent of its standard End User License Agreement or EULA that may apply by default if you do not provide custom terms). Your relationship with Apple is governed by Apple's separate terms, including the Apple Media Services Terms and Conditions and the Apple Developer Program License Agreement (for developers).
2. Description of the Apps and Services
The Apps provide services for all categories on the app store including and not limited to health and productivity. Specific features, content, and functionality vary by App and may be updated from time to time.
Some features or premium content may require in-app purchases or subscriptions (see Section 6). The Apps may include user accounts (via email/password or Apple Sign In), cloud synchronization, analytics, crash reporting, push notifications, and integration with Apple services such as HealthKit, Location Services, or Apple Pay where applicable and with your consent.
We reserve the right to modify, suspend, or discontinue any App, feature, or service (or any part thereof) at any time, with or without notice, for any reason including technical, legal, or business considerations. We are not liable for any modification, suspension, or discontinuation.
3. User Accounts, Registration, and Apple Sign In
Certain features of the Apps may require you to create an account or sign in. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
We support and encourage the use of Apple's Sign In with Apple feature for privacy-preserving authentication. When you use Sign In with Apple, Apple provides us with limited information (such as a unique user ID and, optionally, your name and email address if you choose to share them). We do not receive your actual Apple ID password.
You may not create multiple accounts for the purpose of abusing promotions, referrals, or other features. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. User Conduct and Prohibited Uses
You agree not to use the Apps in any manner that:
• Violates any applicable local, state, national, or international law or regulation, including data protection and privacy laws;
• Infringes or violates the intellectual property rights, privacy rights, publicity rights, or other rights of any third party;
• Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
• Attempts to gain unauthorized access to the Apps, our servers, or any related systems or networks, or circumvents any security or authentication measures;
• Introduces viruses, malware, Trojan horses, worms, logic bombs, or other malicious or technologically harmful material;
• Interferes with or disrupts the integrity or performance of the Apps or any third-party services used by the Apps;
• Uses the Apps for any commercial purpose not expressly authorized by us in writing (e.g., reselling access or scraping content);
• Collects or harvests any information from the Apps, including user data, without our prior written consent; or
• Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity.
We reserve the right (but have no obligation) to investigate and take appropriate action, including removing content, suspending or terminating accounts, and reporting to law enforcement, for any violation of these Terms.
5. Intellectual Property Rights
The Apps, including all content, features, functionality, software, code, designs, text, graphics, images, trademarks, logos, and other intellectual property (collectively, "Company IP"), are owned by Company or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps solely for your personal, non-commercial use on Apple devices that you own or control, in accordance with Apple's then-current End User License Agreement (or these Terms if they supersede it).
You may not: copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, or create derivative works of the Apps or Company IP, except as expressly permitted by applicable law or these Terms.
If you submit any ideas, suggestions, feedback, or other content to us ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, distribute, and exploit such Feedback in any manner and for any purpose without compensation or attribution to you.
6. In-App Purchases, Subscriptions, Payments, and Billing
6.1 General
Certain features, content, premium functionality, or services within the Apps may be available only through in-app purchases ("IAP") or auto-renewable subscriptions ("Subscriptions") offered via Apple's In-App Purchase system. All such transactions are processed exclusively by Apple. Company does not collect, store, process, or have access to your credit card information, billing address, or other payment details. Apple handles all payment processing, billing, receipts, and related customer service for IAP and Subscriptions.
Prices for IAP and Subscriptions are set by Company and displayed in the App or App Store before purchase. Prices may vary by region, device, or promotional offers and are subject to change. Applicable taxes may be added at checkout.
By completing a purchase, you agree to pay all charges associated with that transaction, including any applicable taxes, and authorize Apple to charge your selected payment method.
6.2 Subscriptions and Auto-Renewal
Subscriptions automatically renew at the end of each billing period (e.g., weekly, monthly, yearly, or as otherwise specified) unless you cancel the auto-renewal at least 24 hours before the end of the current period. The renewal will be charged to your Apple ID payment method on file.
Before you subscribe, the App will clearly describe what you will receive for the subscription price (e.g., number of premium features unlocked, cloud storage amount, ad removal, content access, frequency of updates or issues if applicable, or other ongoing value). This information is also available in the App Store listing and subscription management screens.
You can manage your Subscriptions, view billing history, and turn off auto-renewal at any time by going to Settings > [Your Name] > Subscriptions on your Apple device, or through the App Store app. Canceling a Subscription stops future billing but does not entitle you to a pro-rata refund for the current period (subject to Apple's refund policies).
We may offer introductory or promotional pricing, free trials, or other offers. Free trials convert to paid Subscriptions automatically unless canceled before the trial ends. The length of any trial, what happens at the end of the trial, and the full price will be clearly disclosed before you start the trial.
Upgrades, downgrades, and changes between subscription tiers are handled according to Apple's subscription management rules and our applicable policies (disclosed in the App where relevant).
6.3 Refunds, Cancellations, and Apple Policies
All sales of digital content, IAP, and Subscriptions are generally final and non-refundable, except as required by applicable law or as provided under Apple's refund policies. Apple, not Company, controls refund requests. You may request a refund directly through Apple (via reportaproblem.apple.com or Apple Support). Company has no control over Apple's decisions regarding refunds and is not responsible for any denial of a refund request.
If a Subscription or IAP is canceled or terminated by you or by us (for violation of these Terms), you will lose access to the associated premium features or content at the end of the current paid period. No credit or refund will be provided for partial periods.
We reserve the right to change Subscription prices or terms upon reasonable notice. Continued use after a price change constitutes acceptance of the new price.
6.4 Apple Pay and Other Payment Methods
Where Apple Pay is offered for any eligible transactions, all necessary purchase information (amount, merchant details, etc.) will be clearly presented to you before confirmation. Apple Pay transactions are subject to Apple's terms and security features.
7. Third-Party Services, Links, and Integrations
The Apps may integrate with, link to, or rely on third-party services, SDKs, APIs, or websites ("Third-Party Services"), including but not limited to: Apple services (Sign In with Apple, In-App Purchase, App Store, optional diagnostics), analytics and crash reporting providers (e.g., Firebase, Sentry, or similar), cloud storage providers, advertising networks (subject to App Tracking Transparency consent where required), mapping services, social login providers, or other partners.
These Third-Party Services are governed by their own terms of service and privacy policies. We are not responsible for the content, accuracy, availability, security, or practices of any Third-Party Services. Your use of Third-Party Services is at your own risk. We encourage you to review their policies.
We may receive limited data from or share limited data with these providers solely to enable the features you use (e.g., crash logs to diagnose bugs, analytics to improve the App). Such sharing is disclosed in our Privacy Policy.
8. Support, Bug Reporting, Updates, and Service Availability
We strive to provide high-quality, reliable Apps and to address issues promptly. However, the Apps are provided on an "AS IS" and "AS AVAILABLE" basis (see Disclaimers below).
To report bugs, crashes, performance issues, or to provide feedback:
• Use any in-app feedback, support, or "Report a Problem" feature if available; or
• Email us at [email protected] with details including your device model, iOS version, App version, steps to reproduce the issue, and any crash logs or screenshots.
We appreciate reports and will make reasonable efforts to investigate and address valid issues in future updates. We do not guarantee a specific response time, fix timeline, or that every reported issue will be resolved. Some issues may be device-specific, related to third-party services, or outside our reasonable control.
We may release updates, bug fixes, security patches, or new features from time to time. You are responsible for installing updates. We are not liable for any issues arising from using outdated versions of the Apps.
The Apps may occasionally be unavailable due to maintenance, updates, network issues, Apple server problems, or other reasons beyond our reasonable control. We do not guarantee uninterrupted, error-free, or bug-free operation.
9. Disclaimers and Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPS AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE APPS WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, BUG-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE APPS OR ANY CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; OR (D) THE RESULTS OBTAINED FROM USE OF THE APPS WILL BE ACCURATE, RELIABLE, OR COMPLETE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH CASES, THE REMAINING PROVISIONS SHALL CONTINUE IN FULL FORCE AND EFFECT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR OTHER DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE APPS; (B) ANY BUGS, ERRORS, OR INTERRUPTIONS IN THE APPS; (C) ANY CONTENT, CONDUCT, OR ACTIONS OF THIRD PARTIES; (D) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT OR DATA; OR (E) ANY OTHER MATTER RELATING TO THE APPS OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APPS OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (I) THE TOTAL AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED US DOLLARS (USD $100).
THE FOREGOING LIMITATIONS AND EXCLUSIONS APPLY REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.
11. Indemnification
You agree to defend, indemnify, and hold harmless Company and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Apps; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content or data you submit, post, or transmit through the Apps.
12. Termination and Suspension
We may, at our sole discretion and without prior notice, suspend, restrict, or terminate your access to the Apps or any features (including any account) if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason, including to protect the Apps, other users, or us.
You may stop using the Apps at any time. If you wish to delete your account and associated data, please contact us at [email protected]; note that some data may be retained as described in the Privacy Policy for legal or operational reasons.

Privacy Policy

1. Introduction and Scope
This Privacy Policy ("Policy") describes how Top Developer LLC ("Company", "we", "us", or "our") collects, uses, discloses, retains, and protects personal information in connection with our mobile applications (the "Apps" or "App") available on the Apple App Store. It applies to all users of our Apps, including visitors and registered users.
This Policy is designed to comply with Apple's App Store Review Guidelines (particularly Section 5.1 on Privacy), the Apple Developer Program License Agreement, and applicable data protection laws including but not limited to the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), the Children's Online Privacy Protection Act (COPPA), and other relevant regulations in the jurisdictions where our Apps are available.
By using any of our Apps, you acknowledge that you have read and understood this Policy. If you do not agree with our practices, please do not use the Apps.
2. Information We Collect
We collect information to provide, improve, personalize, and secure our Apps and services. The specific data collected varies by App and feature. We follow data minimization principles—we only collect what is reasonably necessary for the stated purposes. Refer to each App's listing in the App Store (App Privacy section) for the nutrition label summary of data collected for that specific App.
We may collect the following categories of information (not all categories apply to every App or every user):
2.1 Account and Profile Information
If you create an account or use Sign In with Apple: name (first/last or full), email address, unique user identifier (provided by Apple or generated by us), profile picture or avatar (if you upload one), and any other profile details you voluntarily provide. When using Sign In with Apple, we receive only the information you choose to share (Apple may hide your email with a relay address).
2.2 Usage, Analytics, and Performance Data
Information about how you interact with the App, including features used, screens viewed, session duration and frequency, in-app actions and events, search queries, preferences, and error or crash reports. This helps us understand usage patterns, improve the App, fix bugs, and prioritize features. We use analytics and crash reporting SDKs (examples: Google Firebase Analytics/Crashlytics, or similar providers we engage under data processing agreements).
2.3 Device, Technical, and Diagnostic Information
Device model and manufacturer, operating system and version (iOS/iPadOS), App version and build, device identifiers (such as IDFV - Identifier for Vendor, or Apple's anonymous device identifiers), IP address (which may be used to approximate general location or for security/fraud prevention and is often truncated or hashed), language and region settings, screen size and orientation, battery level or other system status (if relevant to features), and diagnostic/crash log data (stack traces, device state at time of crash). Apple may also provide aggregated or anonymized diagnostics if you opt in to iOS diagnostics sharing.
2.4 Location Information
Precise or approximate location data (via GPS, Wi-Fi, cellular, or iBeacon) only if you grant permission through iOS Location Services and the App uses location-dependent features (e.g., maps, nearby content, geofencing, or location-based reminders). You can revoke location permission at any time in iOS Settings. We do not use location for advertising unless explicitly disclosed and consented to via App Tracking Transparency where required.
2.5 Health, Fitness, and Sensitive Data (if applicable)
If the App integrates with Apple's HealthKit or similar frameworks (e.g., for step counts, workouts, heart rate, sleep, nutrition, or other health metrics), we access only the specific data types you explicitly authorize in the Health app permissions dialog. Such data is considered sensitive. We use it only for the features you enable, do not sell it, and apply extra security and consent safeguards as required by Apple and applicable law (including HIPAA where relevant, though most consumer Apps are not covered entities).
2.6 In-App Purchases, Subscriptions, and Transaction Data
Information related to purchases and subscriptions made through Apple's In-App Purchase system, such as product identifiers, transaction receipts or identifiers (provided by Apple), subscription status and expiration dates, and whether a purchase was successful. We do NOT receive or store your full payment method details, credit card number, billing address, or Apple ID password. Apple provides limited transaction metadata to the developer for fulfillment and customer support purposes.
2.7 User-Generated Content and Communications
If the App allows posting, uploading, or sharing content (photos, videos, text, comments, drawings, voice recordings, etc.), or sending messages: the content itself, associated metadata (e.g., timestamp, device info), and any captions or descriptions you provide. We process this content to provide the sharing or social features you use. Publicly shared content may be visible to other users of the App.
2.8 Advertising, Tracking, and Third-Party Identifiers
If the App displays advertisements or uses advertising SDKs: the Identifier for Advertisers (IDFA) or other advertising identifiers, only with your explicit consent via Apple's App Tracking Transparency (ATT) prompt. We respect your ATT choice. We may also receive aggregated or anonymized advertising performance data. We do not "sell" personal information for monetary or other valuable consideration as defined under CCPA without providing the required opt-out mechanisms and disclosures.
2.9 Information from Apple and Other Third Parties
When you use Sign In with Apple, In-App Purchases, or other Apple services, Apple may provide us with limited information necessary to authenticate you or fulfill your request. We may also receive information from other third-party service providers we use to operate the Apps (subject to their privacy policies and our contracts with them).
3. How We Collect Information
We collect information in the following ways:
• Directly from you: When you register, sign in, fill out forms, upload content, make purchases, contact support, or voluntarily provide information.
• Automatically through the App: Via analytics, crash reporting, and performance monitoring SDKs that run when you use the App. This includes usage events, device info, and diagnostic data.
• From Apple: Limited data via Sign In with Apple, transaction receipts for IAP/Subscriptions, and optional system diagnostics.
• With your permission: Location Services, HealthKit, Camera/Photos, Microphone, Contacts, or other iOS permissions you explicitly grant. You can manage these in iOS Settings > Privacy & Security.
• From third-party providers: Aggregated or limited data from analytics, advertising, or infrastructure partners under contract.
4. How We Use the Information
We use the collected information for the following purposes (and only to the extent necessary and with appropriate legal basis):
• To provide, operate, maintain, and improve the Apps and their features and services;
• To personalize your experience (e.g., remember preferences, recommend content, or tailor features);
• To process in-app purchases, subscriptions, and deliver premium content or features you have paid for;
• To authenticate users (especially via Sign In with Apple) and secure accounts;
• To analyze usage, diagnose bugs and crashes, monitor performance, and fix technical issues (this helps make the Apps more reliable and bug-free);
• To communicate with you about the Apps, updates, new features, support requests, or important notices;
• To prevent fraud, abuse, security incidents, and enforce our Terms of Service;
• To comply with legal obligations, respond to lawful requests from authorities, and protect our rights and the rights of users;
• For research and development to improve our products and services (using aggregated or anonymized data where possible);
• With your consent, for marketing communications or personalized advertising (you can opt out); and
• Any other purpose disclosed to you at the time of collection or with your consent.
Paid functionality or core App features are never conditioned on you granting access to personal data beyond what is strictly necessary for that feature. We obtain consent where required (including via iOS permission prompts and purpose strings in our Info.plist, which clearly describe the intended use of sensitive data).
5. Legal Bases for Processing (GDPR and Similar Laws)
Where the GDPR or equivalent laws apply (e.g., EEA, UK, Switzerland), we process personal data on one or more of the following legal bases:
• Performance of a contract: To provide the App features and services you request (e.g., account creation, IAP fulfillment, cloud sync).
• Consent: For optional features like personalized ads, certain analytics, location tracking, Health data access, or marketing emails (you can withdraw consent at any time via iOS settings or by contacting us).
• Legitimate interests: To improve the Apps, prevent fraud, ensure security, analyze usage in aggregated form, and provide customer support, provided these interests are not overridden by your rights and freedoms.
• Legal obligation: To comply with tax, accounting, anti-fraud, or other legal requirements.
6. Sharing and Disclosure of Information
We do not sell your personal information for monetary consideration in the traditional sense. We share information only as described below and only with parties that provide equivalent or stronger privacy protections than those described in this Policy (as required by Apple's guidelines):
6.1 Service Providers and Processors
We engage trusted third-party companies and individuals to perform services on our behalf, such as:
• Analytics and crash reporting (e.g., Google Firebase, or equivalent providers under Data Processing Agreements);
• Cloud hosting, storage, and backend infrastructure;
• Customer support and communication tools;
• Payment processing (handled exclusively by Apple for IAP/Subscriptions);
• Advertising or attribution partners (only with ATT consent where tracking is involved); and
• Other operational service providers.
These providers are contractually bound to use the data only for the purposes we specify, protect it with appropriate technical and organizational measures, and not to use or disclose it for their own marketing purposes. They provide the same or equivalent level of protection as required by this Policy and Apple's App Store Review Guidelines.
6.2 Apple and Apple Services
We share limited information with Apple as necessary for: Sign In with Apple authentication, processing and validating In-App Purchases and Subscriptions (Apple provides transaction receipts), App Store distribution and analytics, and optional diagnostics. Apple's handling of any data it receives is governed by Apple's Privacy Policy (available at apple.com/privacy).
6.3 Legal Requirements and Protection of Rights
We may disclose information if required to do so by law, regulation, court order, subpoena, or governmental request, or if we believe in good faith that disclosure is necessary to: protect our rights, property, or safety or that of our users or the public; enforce our Terms of Service; investigate fraud or security issues; or respond to an emergency.
6.4 Business Transfers
In the event of a merger, acquisition, reorganization, sale of assets, or similar corporate transaction, personal information may be transferred to the successor entity as part of the transaction. We will notify affected users and update this Policy as appropriate.
6.5 Aggregated and Anonymized Data
We may share aggregated, anonymized, or de-identified data (that cannot reasonably be used to identify you) for research, marketing, or other purposes. Such data is not personal information.
6.6 No Unauthorized Sharing
We do not share personal information with third parties for their own direct marketing purposes without your consent. Any sharing for advertising or tracking purposes requires your explicit ATT consent where applicable.
7. Data Retention
We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, to provide the Apps and services, to comply with our legal obligations (e.g., financial and tax records typically retained for 7–10 years or longer depending on jurisdiction), to resolve disputes, enforce our agreements, or as otherwise disclosed to you.
When information is no longer needed, we will securely delete, anonymize, or aggregate it. You may request deletion of your personal data (subject to legal and operational retention requirements) by contacting us at [email protected]. Note that some data (e.g., transaction records for active subscriptions or legal holds) may need to be retained even after an account deletion request.
8. Your Privacy Rights and Choices
Depending on your jurisdiction and the applicable law, you may have some or all of the following rights regarding your personal information:
Access and Portability
You can request a copy of the personal information we hold about you and, where technically feasible, receive it in a portable, machine-readable format.
Correction
You can request that we correct inaccurate or incomplete personal information.
Deletion / Right to be Forgotten
You can request that we delete your personal information, subject to legal exceptions (e.g., we may retain data to comply with legal obligations, prevent fraud, or complete transactions you initiated).
Restriction and Objection
You can request that we restrict processing of your data in certain circumstances, or object to processing based on legitimate interests (we will then assess whether our interests override yours).
Withdraw Consent
Where processing is based on consent, you can withdraw it at any time. This will not affect the lawfulness of processing before withdrawal. For iOS permissions (location, Health, tracking, etc.), manage them directly in iOS Settings > Privacy & Security > [App Name]. For analytics or marketing, contact us or use in-app controls if available.
Do Not Sell or Share (CCPA/CPRA)
